All residential foreclosure cases for homestead residences
that were filed on or after July 12, 2010 are automatically
referred to the RMFM Program. If your case was filed
before this date, you may request a referral to the
RMFM Program by filing this form. File this request
with the Court and mail a copy of the request to the
lawyer for the Lender.
Borrower’s Request for Plaintiff’s
Disclosure for Mediation (Exhibit 6) (download

Borrowers may request the following from lenders using
this form:
1) Documentary evidence the plaintiff is the owner
and holder in due course of the note and mortgage
sued upon;
2) A history showing the application of all payments
by the borrower during the life of the loan;
3) A statement of the plaintiff’s position on
the present net value of the mortgage loan; and
4) The most current appraisal of the property available
to the plaintiff.

This form must be delivered to the RMFM office no
later than 25 days before mediation (in other
words at any time until 25 days before the scheduled
mediation date). The lender must transmit the disclosure
to the Program’s web-enabled IT platform at
least 10 business days before the scheduled mediation
date and the RMFM Program will mail a copy to the
Homeowner.
BORROWER’S FINANCIAL DISCLOSURE FOR
MEDIATION
All borrowers must speak with a foreclosure counselor
and submit financial disclosure to the RMFM program
before mediation can be scheduled.

All Homeowners who are participating in the RMFM Program
must complete this form and mail, hand-deliver or
fax a signed copy of the Release (see below or see
page 3 of the Worksheet) to the RMFM Office. You should
complete the information for this form with your foreclosure
counselor, who will then upload this document onto
our web-enabled IT Platform to be shared with the
lender. You must complete this Worksheet in order
to proceed to mediation.

Additional Documents that most banks require
if you are seeking a loan modification:
Proof of Income – in addition
to paystubs, banks also want proof of any other income
you may have such as rental income, contribution letters
from children or parents, copy of benefits letters
for Social Security;
Child support or alimony – copies of written
legal documents or court decrees stating amounts payable
and period of time
If someone else is contributing to the mortgage
payment (such as an adult child or parent), then write
a letter describing this contribution and have the
person contributing sign and date the letter.
If renting out part of the house, attach a copy
of the rental agreement and proof of payment.

will also need to fill in and sign the Request
for Modification and Affidavit (RMA Form)

form captures information on the homeowner’s
income, expenses, other liens, and liquid assets.
It includes a Hardship Affidavit. It must be signed
by all borrowers.
