Contact us so that we can link you to your case: We are not linked to the Clerk’s website. This means that when you file a motion or Notice of Appearance, we do not receive it and do not know that defense counsel exists in a case. Please send an email to with an attachment of the motion or notice so that we can connect you to your cases and send you notices.

Foreclosure Counseling: The AO requires that borrowers go through foreclosure counseling and submit a Financial Worksheet that is released to the Plaintiff in order to go to mediation. The Administrative Order provides that the foreclosure counselors must speak with the borrower (not the attorney). As defense counsel, you are free to prepare this form, have your clients sign it, and send it to us and have your clients, with or without your participation, receive some free, confidential credit counseling from the foreclosure counselors. Ask your clients to tell the foreclosure counselors that they are doing this so that the foreclosure counselors do not prepare the Financial Worksheet as well. The timeline for contacting the borrower and for completing the foreclosure counseling continues throughout this process. The Financial Worksheet can be amended at any time.

Our foreclosure counselors are Consolidated Credit Counseling, a HUD certified non-profit agency. Their phone number for your clients to call is (866) 900-4254. Note that Consolidated only handles the foreclosure counseling. Please do not ask scheduling or other questions of them.

The AO requires a signed Financial Worksheet from each borrower in order to schedule mediation.

Timeline: The program has 60 days to contact the borrower and borrowers have 90 days to complete foreclosure counseling. Notices of Non-Participation will be sent if the program is unable to contact the borrower after 60 days and if the foreclosure counseling is not complete after 90 days.

Signed Release: The Release page (page 3) of the Financial Worksheet must be returned signed by all borrowers to the Program. This can be returned as an attachment via email, by fax to (561) 598-6265, or by hand-delivery or mail to our address, 1601 Belvedere Road, Suite 304E, West Palm Beach, FL 33406

Disclosure from Plaintiffs: Exhibit 6, Borrower’s Request for Disclosure from Plaintiffs, should be submitted to the RMFM program and not filed in court. The AO provides that Plaintiffs have to provide this disclosure within 10 days before mediation, so mediation must be set before the Plaintiffs must provide this disclosure. Exhibit 6

Mediation scheduling: We try to contact defense counsel to choose a convenient date. Please respond promptly to calls or emails from our Mediations Coordinator, Hutch Floyd or our Mediation Assistant, Miriam Erian. If you do not get back to one of them to work out a date, then a date will be picked without your input. Mediations take place in our offices.

Uploading documents: Uploading and downloading documents from the RMFMP website is both quick and easy. Please look on the RMFMP website for the Plaintiff’s disclosures. Also, if you are preparing your client’s Financial Worksheet and other documents, please upload them into the case on RMFMP and then send an email to Erin Kelly, one of our Mediation Assistants when you have done so letting her know.
